HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW APPLICATION U/S 482 No. - 6101 of 2019 Court No. - 29 HON'BLE MANOJ BAJAJ, J. Applicants- accused have approached this Court through this application under Section 482 Code of Criminal Procedure for quashing of the impugned order dated 17.7.2019 passed by Additional Sessions Judge, court no.8, Faizabad in Criminal Revision No.123 of 2018, titled Ramapati Pandey and another Vs. State of U.P., whereby the order dated 19.6.2018 dismissing their application for discharge under Section 239 Cr.P.C., passed by Chief Judicial Magistrate, Faizabad in Criminal Case No.4153 of 2008, under Sections 419, 420, 467, 468, 471 IPC, registered at Police Station Kotwali Ayodhya, District Faizabad, has been upheld. The petition was filed in August, 2019 and eversince its filing, the case has been adjourned on numerous occasions, which is pending at the admission stage and even notice has not been issued to the other side. With the efflux of time as a consequence of the impugned orders, trial against the accused must have progressed, as there is no interim stay operating in respect of the trial court proceedings. Thus, the cause of action raised in this petition does not exist any more for adjudication. Reslutantly, without meaning any expression of opinion on the merits of the case, the petition is hereby dismissed.
