[2025:RJ-JP:21154] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 7656/2025 Smt. Sunita Dhawan W/o Shri Rajesh Bhatia, Aged About 59 Years, Resident Of House No.3121/6 Palsania Road, Nasirabad, Ajmer. ----Petitioner Versus
1. The Addl. Chief Secretary, School Education, Secretariat, Jaipur.
2. The Director, Secondary Education, Bikaner. ----Respondents For Petitioner(s) : Mr. M.F. Baig For Respondent(s) :
HON'BLE MR. JUSTICE SUDESH BANSAL Order 20/05/2025
1. Petitioner has preferred instant writ petition under Article 226 of the Constitution of India, challenging her transfer order dated 12.04.2025 whereby she has been transferred on the post of Principal from GSSS Deranthu Block Srinagar, Tehsil Nasirabad, District Ajmer to Government Girls Senior Secondary School, Nyara, Ajmer whereagainst she preferred an Appeal No. 2549/2025 before the Rajasthan Civil Services Appellate Tribunal, Jaipur, on the ground that her retirement on attaining the age of superannuation is only after seven months. The Tribunal dismissed the appeal with observation that the transfer of petitioner has been made within District Ajmer itself, hence, same does not affect her case for release of pension.

2. This Court, having considered the case of petitioner on merits, finds that the transfer order does not suffer from any malafides or violation of the statutory rules or the transfer policy of the Government. Since the transfer of petitioner is within District, the ground that her retirement is due soon after seven months, does not inspire confidence.
3. Counsel for petitioner, having instructions from the petitioner, does not want to press the writ petition and seeks permission to withdraw the same.
4. Accordingly, the writ petition is dismissed as withdrawn with liberty to the petitioner to submit a representation before the respondents, if so desired.
5. Stay application and other pending application(s), if any, stand disposed of.
