JUSTICE WASIM SADIQ NARGAL, JUDGE ORDER 28.08.2025 Learned counsel for the parties submit that the issue, which is projected in the instant petition is covered by the judgment passed by this Court in WP(C) No. 533/2024 decided on 22.10.2024, which has already been upheld by the Division Bench of this Court in LPA No. 258/2024 decided on 12.03.2025. Both the parties further submit that the similar issue has already been decided by the Apex Court in Civil Appeal No. 10899/2013 in case titled ‘Dileep Kumar Panday vs. Union of India & Ors’ decided on 21.05.2025. Since the issue projected in the instant petition is covered by judgment passed by this Court (supra), which has been upheld by the Division Bench and also the law laid down by the Apex Court, is applicable to the case in hand. Accordingly, the instant petition is not maintainable and same is liable Sr. No. 11 2 | P a g e WP(C) No. 196/2022 to be dismissed in light of the law laid down by this Court and as also by the Apex Court. In the aforesaid backdrop, learned counsel for the petitioner seeks withdrawal of the instant petition. Prayer allowed. Accordingly, the instant petition is dismissed as withdrawn along with all connected application(s). Interim direction, if any, shall stand vacated.
