1. Heard learned counsel for the applicant as well as Sri Rajdeep Singh, learned AGA-I appearing for the State-opposite party no.1. Though notice has been served on opposite party no.2, but none appeared on behalf of opposite party no.2 .
2. By means of this application, the applicant has prayed for setting aside the order dated 02.07.2024 passed by the Civil Judge (Junior Division)/FTC (Domestic Violence Act), Sultanpur with a further prayer to quash the entire proceedings of Criminal Case No.212 of 2024, Shama Praveen Vs. Mohammad Tayyab, under Section 12 of the Domestic Violence Act, 2005, Police Station Kotwali Nagar, District Sultanpur.
3. From perusal of the impugned order, it appears that the trial court has only registered the case and ordered to list the same for hearing on
03.08.024. Even from the record, it is not borne out that any summon has been issued against the applicant and the trial court has taken cognizance of the matter.
4. The application is misconceived. It is accordingly rejected. November 12, 2025 Rao/- Versus Counsel for Applicant(s) : Abdul Samad, Divya Singh, Sunil Sharma Counsel for Opposite Party(s) : G.A.
