Order on Board 07.05.2025
1. The limited relief that the petitioners seek for in the present writ petitions is for the consequential benefits of salary for the period between 05.10.2015 to 25.09.2018.
2. The learned counsel for the petitioners submits that during the said period the petitioners were terminated by an illegal order, which has subsequently been set-aside by the respondent authorities and the petitioners subsequently have been found to be validly entitled for appointment and he has been taken back in service. However for the intervening period of around 35 months i.e. between 05.10.2015 to 25.09.2018 the petitioners have not been paid the salary.

3. The limited prayer that the petitioners seek for at this juncture is for a direction to the respondent authority to decide the representations to be filed by the petitioners for claiming the wages for the period between 05.10.2015 to 25.09.2018.
4. The State counsel does not have any objection on the submission made by the counsel for the petitioners. The State counsel however submits that it is a case where admittedly the petitioners have not discharged their duties during the said period, however a decision as regards how that period has to be treated and whether the petitioners are entitled for wages or not has to be first decided by the concerned authority.
5. Given the aforesaid facts, the writ petitions at this juncture stand
disposed of granting liberty to the petitioners to approach before the respondent authority by filing a representation in respect to the grievance raised herein. It is directed that in the event of filing of the representation, the respondent authority shall consider the representation and decide the same in accordance with law within an outer limit of 4 months from the date of receipt of the copy of this
order.
6. With the aforesaid observations, the present writ petition stands
disposed of. Sd/-
