HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 11299 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. The present bail application has been filed by accused-applicant seeking bail in Case Crime No.272 of 2025 under Sections 309(4), 318(4), 317(2) of BNS P.S. Kursi, district Barabanki. In the prosecution case, it is alleged that three persons on rider motorcycle have snatched the bag of salesman and ran towards Nigoha. Learned counsel for the applicant submits that the co-accused Akash Verma and Rachit Verma who were assigned similar role have been enlarged on bail by this Court vide order dated 12.11.2025 passed in criminal misc. bail application Nos. 10539 of 2025 and 10310 of 2025. Learned counsel for the applicant seeks parity with the order of the co-accused. It is further submitted that the applicant is languishing in jail since 12.09.2025 without having any criminal antecedent. There is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned AGA has opposed the bail application, however, could not dispute the fact that it is a case of parity. Accordingly, the bail application is allowed on the ground of parity. Let the applicant Sunil Kumar Vishwakarma @ Sandeep Kumar Vishwkarma, be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court.
