“Grievance of respondent no.1 is that she is a teacher appointed on ad-hoc basis in Maharaja Lakshmeshwar Singh Memorial College on 12.08.1985. In the year 1986, the college where respondent
Patna High Court L.P.A No.220 of 2019(11) dt.10-04-2025 2/3 no.1 was working was taken over by the University at the behest of State. In this backdrop read with the service rendered by the respondent no.1 in the University, her grievance is that she is entitled for absorption/regularization. Before examining whether respondent no.1 is entitled for absorption/ regularization, it is necessary to peruse the terms and conditions imposed by the State Government and University while taking over the said college and merging its staff in the University and their service conditions were required to be examined only with reference to the taking over the college by official memorandum/ notification or order of the University or Government or any other official material information. Therefore, respondents/appellants are hereby
directed to furnish relevant material information so as to determine whether service condition of respondent no.1 is determined in such of those documents or not?
2. Be that as it may, having regard to the service rendered by the respondent no.1 from the year 1985 and she is stated to be in service even to this day, she is entitled to consider her name for absorption in the light of Hon’ble Supreme Court decision in the case of Secretary, State of Karnataka vs. Uma Devi (3) reported in (2006) 4 SCC 1; AIR 2006 SC 1806 read with recent decision in the case of Jaggo vs. Union of India and Ors. reported in 2024 SCC OnLine SC 3826, on this issue University may apprise State Government in writing along with service particulars of respondent before the next date of hearing.
