02/ 11.07.2025: Heard, learned counsel for the petitioner and learned counsel for the State.
2. This is an application filed by the petitioner praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 314, 316(4), 318(4) & 3(5) of B.N.S.
3. The allegation against this petitioner that he being the employee of Bharat Financial Inclusion Limited, used to collect installment amount from the loanees, but did not deposit the same in the Company.
4. The learned counsel for the petitioner submits that it was a natural practice to deposit the amount in the account without getting the receipt. This system continued, but for reasons best known, the petitioner has been made an accused.
5. The learned APP opposes the prayer for anticipatory bail.
6. After hearing the parties, I find that defence of the petitioner is absolutely not tenable as there is an allegation of defalcation by the petitioner, who has defalcated money of the loanee. Thus, I find that this is not a fit case for grant of anticipatory bail to the petitioner.
7. Considering the nature of allegation, I am not inclined to entertain the
anticipatory bail application. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Barhait P.S. Case No.114 of 2024, pending in the Court of learned S.D.J.M., Sahibganj, stands rejected.
