HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 10011 of 2023 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J. HON'BLE PRASHANT KUMAR, J. 1. Heard learned counsel appearing on behalf of the parties. 2. This is a writ petition under Article 226 of the Constitution of India, wherein the writ petitioner is aggrieved by an order dated August 12, 2023 passed by the respondent No.2. 3. Upon perusal of the said order, we find that the reasons assigned for rejecting the claim of the petitioner are based on statements made by certain unknown individuals who are residents of Village Chandrampur. There is no direct evidence nor any proof that has been provided by the authorities even in their counter affidavit. 4. In light of the same, we are of the view that the impugned order dated August 12, 2023 is not maintainable and is accordingly quashed and set aside, with a direction to the authorities to grant further opportunity of hearing to the petitioner and pass a reasoned order in accordance with law within a period of eight weeks from date. 5. We make it clear that the authority should rely on specific evidence while arriving at the reasoned finding. 6. With the above direction, the writ petition is disposed of.
