Galib Mr. Kapil Guha … for the State – respondent(s) The petitioner has approached this Court as, in spite of the status quo order passed by the learned Civil Court in Partition Suit Case No. 620 of 2022, the police authorities have failed to provide necessary protection to the present petitioner. The petitioner, to that extent, has communicated with the Officer-in- charge of Nowda P.S. Learned advocate for the State has submitted a report which reflects that the police authorities have been aware regarding the order passed in the said suit by the learned Civil Judge (Sr. Divn.), Berhampore, Murshidabad in P.S. Case No. 620 of 2022. The report also reflects that the police authorities have also drawn up a proceeding under Sections 107/116 of the Cr.P.C. against the private respondents or their associates. The petitioner would be at liberty to approach the learned Civil Court for specific direction(s) upon the police authorities for implementation of its order. In case, such order is passed by the learned Civil Court, the police authorities would respect, obey and implement such order. For the time being, the police authorities would keep strict vigil and continue to keep their surveillance. They would also ensure that no breach of the peace and tranquility takes place as also no untoward incident results because of the inimical relationship existing between the parties. With the aforesaid observations, WPA 7985 of 2023 is disposed of. Pending application(s), if any, is also disposed of. Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate for the petitioner.
