Heard learned counsel appearing on behalf of the parties. 2. This is a writ petition under Article 226 of the Constitution of India, wherein the writ petitioners have made the following main prayer:- "(i) Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to make the payment of ex-gratia amount to the petitioners whose son i.e. Iqbal Ahmad working at 33/11 KV Vidyut Vitran Mandal, Subhagpur Sub Station Gonda as contractual (Kaushal Labour) passed away on 18.04.2021 due to COVID-19 while he was in service and is working with Madhyanchal Vidyut Vitran Nigam, Colonelganj, Gonda as per the Government Order issued by the Government of Uttar Pradesh." 3. The impugned order does not take into account the letter issued by the Executive Engineer dated June 24, 2021, which categorically stated that the son of the petitioners, namely, Iqbal Ahmad was a COVID warrior and was involved in 24x7 duty. 4. In light of the same, the impugned order is quashed and set aside with a direction upon the authorities concerned to consider the said letter issued by the Executive Engineer. An opportunity of hearing should be granted to the petitioner, and thereafter, pass a reasoned order within a period of sixteen weeks from date.
