2.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case and they are in judicial custody from last two months. Learned counsel further submits that the present case pertains to a free fight and that there are cross-cases filed by the petitioner and as per the statement of complainant the main allegation is levelled against the other co-accused Heeralal S/o Bhojaji, Hanuman S/o Bherulal and Jagdish S/o Prabhulal, charge-sheet is about to be filed and the trial of the case will take considerable time, therefore, further custody of the petitioners would not serve any fruitful purpose, so, the petitioners may be released on bail.
3. Learned Public Prosecutor and learned counsel for the complainant have vehemently opposed the submissions made by the learned counsel for the petitioner.
4. Heard learned counsel for both the parties and perused the material available on record.
5. Considering the fact that petitioners are in judicial custody from last two months; present case pertains to a free fight and that there are cross-cases filed by the petitioner and as per the statement of complainant the main allegation is levelled against the other co-accused Heeralal S/o Bhojaji, Hanuman S/o Bherulal and Jagdish S/o Prabhulal and charge-sheet is about to be filed and trial of the case may take considerable time, thus, without commenting any opinion on the merits/demerits of the case, this Court deems it just and proper to allow this bail application.
