Nadeem Ahmed …for the respondents Liberty is granted to the learned advocate for the petitioner to amend the cause title. The petitioner asserts that an electricity connection has been provided to the premises of respondent nos. 6 to 9 by installing two poles on a plot of land owned by the petitioner. The petitioner contends that, in the process of installing the poles, no permission was sought from him by the licensee. On the other hand, learned counsel for respondent nos. 6 to 9 submits that the petitioner acquired the property on January 21, 2020, when the poles had already been installed. It is further claimed that the poles have been erected on a common pathway. Given the nature of the dispute, I am of the opinion that the dispute between the petitioner and respondent nos. 6 to 9 should be adjudicated by the 2 concerned District Magistrate, in accordance with Proviso 3(b) of the Work of Licensees Rules, 2006. I grant liberty to the petitioner to submit a representation before the concerned District Magistrate. The District Magistrate shall resolve the issue within three months from the date of the representation, affording an opportunity for a hearing to the petitioner, respondent nos. 6 to 9, and representative from WBSEDCL. Accordingly, WPA 7967 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
