Heard Sri Ashok Khare, learned Senior Counsel assisted by Sri S.K.Srivastava, lerned counsel for the petitioners and Sri Manvendra Dixit, learned Standing Counsel. 2.It is very unfortunate that a very higher officer of Education Department i.e. Director of Education (Secondary) has passed the impugned orders in pursuance of an order of this Court in the earlier round of litigation in Writ-A No.768 of 2023, Om Prakash Vs. State of U,.P. & Ors, without taking note of its contents and rejected the claim to include prior service of the petitioners. 3. Learned Senior Counsel appearing for petitioners has referred a judgment passed by Single Bench of this Court in earlier round of litigation in Om Prakash (supra) and Division Bench of this Court passed in Special Appeal Defective No.217 of 2024, State of U.P. & Ors Vs. Dr. Mahendra Singh, Neutral Citation No.2024:AHC:49095-DB that impugned orders are in teeth of said judgments. 4. Learned Standing Counsel is not able to support the impugned orders in light of above referred judgments. 5. In the aforesaid circumstances, not only impugned orders dated 12.12.2024 passed by the Director of Education (Secondary), U.P. are set-aside, but matter is remanded to Director of Education (Secondary), U.P. to pass a fresh order within a period of two weeks from today in the light of above referred judgments and in case petitioners are constrained to approach this Court again on the same issue, Court will be constrained to take a very strict action against the said officer. 6. Copy of this order be sent to the Secretary, Department of Secondary Education, Government of U.P. to look into the matter and to take cognizance of the observations made by this Court. 7. With aforesaid directions, both the writ petitions are disposed of.
