Learned counsel for the petitioner submits that the petitioner is the owner of the Mango Garden ad-measuring Ac.9.49 Cents situated in Sy.No.519/2, at Gounivaripalli Village, Gorantia Mandal, 2. 2 Sri Satya Sai District. It is submitted that the unofficial respondent Nos.4 to 6 filed a suit vide OS No.334 of 1995, for injunction against the petitioner’s father. At the time of admission, the Civil Court granted injunction and subsequently, the Suit was dismissed vide Judgment and Decree dated 14.02.2000. Thereafter, the petitioner is in possession and enjoyment of the subject property. However, at the behest of respondent Nos.4 to 6, respondent No.3 is not extending any support for harvesting the Mangoes in the subject property by keeping the petitioner’s representation dated 21.04.2025 as pending. Learned Government Pleader representing the State 3. submitted that as there are civil disputes between the petitioner and the unofficial respondent Nos.4 to 6, the Police cannot except to extend the security. It is submitted that bind over proceedings vide MC No.39 of 2025 are pending before the Mandal Executive Magistrate. Considering the fact that this is a Mango Season and in view of the efforts of farmers of a Mango Garden, continuance of proceedings vide MC No.39 of 2025 would only lead to loss of income on the investment on the Mango Garden to the petitioner. Hence, respondent No.3 is directed to consider the petitioner’s 4. 3 representation dated 21.04.2025 in accordance with Section 173(3) of BNS, 2023 by duly taking into account the dismissal order dated 21.04.2025 in OS No.334 of 1995 on the file of the District Munsif 'V Court, Hindupur. 5. Accordingly, this Writ Petition is disposed of at the stage of admission itself. There shall be no order as to costs.
