HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 11637 of 2025 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J.
HON'BLE MANJIVE SHUKLA, J.
1. This is a petition under Article 226 of the Constitution of India wherein the writ petitioner has prayed for the following relief:-
"(I) Issue a writ, order or direction in the nature of certiorari to quash the impugned order dated 26.07.2025 passed by the District Magistrate, Barabanki, by which he has rejected the claim of the petitioner under "Mukhyamantri Kisaan evam Sarvhit Beema Yojana, 2017."
2. The contention of the petitioner are that the impugned order rejecting the claim of the petitioner was based on the fact that the deceased was not the bread winner of the family. However, on perusal of the Mukhyamantri Kisaan Evam Sarvhit Beema Yojana, it appears that the scheme applies to the persons who are the head of the family / bread earner in the family. Furthermore, if the income of the family is below Rs. 75,000/-, the scheme would apply to the said family.
3. In the present case, we are faced with a situation where the deceased was 22 years old boy who was unmarried and was working in the fields owned by the father.
4. In light of the same, it appears that he was a bread earner and since, the family income was less than Rs. 75,000/-, the scheme would apply to the said family.
5. In light of the aforesaid tentative findings, the impugned order dated Versus Counsel for Petitioner(s) : Shrddha Srivastava, Shravan Kumar Counsel for Respondent(s) : C.S.C., Zafar Aziz Rekha .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Revenue Deptt. Lko. And 2 Others .....Respondent(s)
26.07.2025 is quashed and set aside with a direction upon the authorities to grant an opportunity of hearing to the petitioner and thereafter, pass a reasoned order in accordance with law within a period of eight weeks from the date of receipt of a certified copy of this order.
6. With the aforesaid observations / directions, the writ petition is disposed of. December 15, 2025 Lokesh Kumar WRIC No. 11637 of 2025 2 (Manjive Shukla,J.) (Shekhar B. Saraf,J.) Digitally signed by :- LOKESH KUMAR High Court of Judicature at Allahabad, Lucknow Bench
