Heard Sri Manoj Kumar Nishad, learned counsel for the petitioner and Sri Badrish Kumar Tripathi, learned Additional Chief Standing Counsel for the State-respondents. 2. By means of the present petition under Section 227 of the Constitution of India, the petitioner has prayed for the following relief: "Wherefore, it is most respectfully prayed that this Hon'ble Court may kindly be pleased to issue a suitable direction commanding to the Principal Judge Family Court, Ayodhya/ opposite party no. 1 to decide the case No. 1022/2023, declaratory suit for Divorce, Mohd. Fahim Qureshi Vs Mrs. Sabreen Bano instituted on 30.10.2023, on behalf of petitioner, within stipulated point of time preferably within three months, contained as Annexure No. 1, to this writ petition." 3. The submission of the learned counsel for the petitioner is that a suit for declaration having Case No. 1022/2023 (Mohd. Fahim Qureshi Versus Sabreen Bano) is pending before the learned Principal Judge, Family Court, District- Ayodhya, since the year 2023. It is submitted on behalf of the petitioner that a written statement was filed on behalf of the respondent No. 2 way back in the year 2024. The 'Issues' have also been framed. Versus Counsel for Petitioner(s) : Manoj Kumar Nishad, Ashutosh Mishra Counsel for Respondent(s) : Mohd. Fahim Qureshi .....Petitioner(s) Principal Judge Family Court District Ayodhya And Another .....Respondent(s) 4. It is also submitted on behalf of the petitioner that the petitioner is working as Deputy Superintendent of Police and is presently posted at district Balia. The respondent No. 2 is working as an Assistant Teacher and is presently posted at District Ayodhya. The submission of learned counsel for the petitioner is that the parties are Muslim by religion and as per law applicable in their case, the divorce between them took place on 23.06.2023 and since then the parties are living separately. 5. Looking into the fact that the pleadings have been exchanged and the 'Issues' have already been framed in the case, there is no occasion to keep the present writ petition pending. 6. In view of the proposed order being passed, issuance of notice to the respondent No. 2 is hereby dispensed with. 7. Accordingly, without entering into the merits of the case, the present writ petition is disposed of at the admission stage itself with direction the learned Principal Judge, Family Court, District- Ayodhya to expeditiously decide the Case No. 1022/2023 (Mohd. Fahim Qureshi Versus Sabreen Bano), after affording due opportunity of hearing to the parties concerned, strictly in accordance with law, as early as possible, preferably within a period of six months from the date a certified copy of this order is produced before the Court. 8.
