HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 3810 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J. 1. Heard Shri Mahendra Pratap Singh, learned counsel for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No. 39 of 2025, under sections 64(1) BNS, Sections 3/4 POCSO Act, P.S. Mill Area, District Raebareli. 3. Learned counsel for the applicant argues that in terms of FIR it was alleged that daughter of the informant aged about 18 years had gone out of home on 6.2.2025 when the applicant committed wrong on her and the entire facts were narrated to the informant. Thereafter, the FIR was lodged on 7.2.2025 and medical examination was done on 10.2.2025. In the two statements the victim has supported the prosecution story. However the medical on record does not corroborate the same. 4. Learned AGA has opposed the bail application. 5. Considering the facts and circumstances and the medical not supporting the incident, however, without commenting upon the merits of the case, the applicant who is in jail since 7.2.2025 and has no criminal history is entitled to be enlarged on bail. In view thereof, the application is allowed. 6.
