GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the respondents in not investigating the complaint by not registering the crime in pursuance of the complaint made by the petitioner on 14-05-2020, though received, resulting calculated strategy of the unsocial elements to grab the property of the 2 petitioner by burying a dead body of an old lady in the lands of the petitioner and not removing the same as illegal, contrary to Section. 89 and 91 of the AP Panchayat Raj Act, voilative of all cannons of law and as such liable to be set aside with a consequential direction to the respondents to remove the dead body forthwith and restore the peaceful possession and enjoyment of the Petitioner in the subject lands to an extent of Ac.3.07 cts covered by R.S.No.255-2 and Ac.1.53 cts covered by R.S.No.256-3 of Urlagudem Village, Chintalapudi Mandal, West Godavari District.” 2. Sri V.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, the Police having received the representation dated 14.05.2020 from the Petitioner, enquired into the matter and found that the matter is purely of civil nature and as such, the Respondent – Police has not registered the case based on the complaint of the Petitioner. 3. Sri S.M.Subhan, learned counsel for the Petitioner would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioner to work out his remedies before appropriate forum in accordance with law. There shall be no order as to costs.
