Heard learned counsel for the parties and perused the record. 2. This writ petition has been filed for the following reliefs:- "i. Issue a writ order or direction in the nature of Certiorary quashing the order dated 20.09.2024, passed by the Respondent No. 2 (Annexue no. 1 to the Writ Petition) ii. Issue a writ order or direction in the nature of Mandamus commanding the Respondents restraining them from interfering into the peaceful possession of the Petitioner over the piece of land situated at Arazi No. 254, admeasuring 1.432 Hectare, village Mahen Bangar, Tehsil Barhaj, District Deoria. iii. Issue a writ order or direction in the nature of Mandamus commanding the Respondents to ensure the construction of Chak Road over Arazi No. 255 situated at Village Mahen Bangar, Tehsil Barhaj, District Deoria." 3. By means of impugned order, the representation of the petitioner has been rejected. It has been stated in the order impugned that after a survey being done, the road has been constructed over the land reserved for chak road. It has also been recorded in the order impugned that in case, petitioner is still aggrieved he may get his land demarcated under Section 24 of the U.P. Revenue Code, 2006 or get his land surveyed under Section 49(5) or 49(6) of the U.P. Revenue Code, 2006. 4. In view of these facts, I am not inclined to interfere in the matter. 5. Accordingly, the writ petition is disposed of with liberty to the petitioner to get his land surveyed as indicated in the order impunged. In case, such an application is filed by the petitioner, the same shall be considered and decided within three months after providing opportunity of hearing to all the parties concerned.
