Devi, learned counsel appearing for the accused petitioners as well as Mr. R. R. Kaushik, learned Addl. P.P., Assam appearing for the State respondent. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioners, namely, Md. Fulkon Ali and Md. Rahman Ali, praying for grant of bail in connection with Shyampur P.S. Case No.14/2025 (corresponding to GR Case No. 588/2025) under Sections 191(2)/191(3)/310(20/324(4)/329(4) the BNS Act. 3. Case diary as called for is received. 4. The case arose out of an FIR with the allegation that pursuant to a meeting in the house of Md. Noor Elias in the village, seven named accused persons including the present two petitioners entered his house by breaking and door and take away several materials including 20,000/-, pump set along with some machines. 5. It is submitted by learned Additional Public Prosecutor that these two accused persons have been examined and their statements recorded. The main implication against these two persons is that the alleged stolen materials were recovered from their house. 6. Considering the progress of investigation with regard to them, recording of their statements and length of detention since 30.07.2025 vis-à-vis statutory period – perhaps they can be enlarged on bail at this stage. In such view of the matter, it is provided that the accused petitioners, named above, shall be released on bail of Rs.25,000/- each with one suitable surety of like amount each to the satisfaction of learned concerned court subject to the following conditions that the petitioners: (a) shall co-operate the remaining investigation.
