OMP(M) No. 93 of 2025. The present application has been filed for condonation of delay in filing the present appeal. It has been averred in the application that impugned judgment and order was passed by the learned District Judge on 02.09.2024, after which legal opinion was sought by the office of the applicant/appellant with respect to lay challenge to the impugned judgment and thereafter steps were taken for engaging the counsel for filing the appeal before this Court. That certified copy of the impugned judgment was applied on 23.09.2024 and the same was received on 23.10.2024. In the said process some delay has occurred, which is neither intentional nor willful, but the same has occurred due to unavoidable circumstances, which were beyond the control of the applicant/appellant. Consequently, in view of the averments as made in the application, which is duly supported by an affidavit and in view of the submissions made by learned counsel for the applicant/appellant, the present application is allowed and delay in filing the appeal is condoned.
