Heard Sri Farhan Sheikh, Advocate holding brief of Sri Iqbal Ahmad, learned counsel for the petitioner, Sri Vishal Tehlani, Advocate holding brief of Sri Pankaj Gupta, learned counsel for the opposite party no.4- Gaon Saha. 2. By means of the instant petitioner, the petitioner has sought issuance of a directions for removal of encroachment made upon land bearing Gata No. 261 measuring 0.1170 hectares, Gata No. 262 measuring 0.0970 hectares and Gata No. 272(Ka) measuring 5.2200 hectares, situated in Village Shakhuiya, Tehsil and District Balrampur, which are recorded as public utility land. 3. On the basis of written instructions proceeding by Tehsildar, Sadar, Balrampur, learned Standing Counsel has informed the Court that proceedings under Section 67 of U.P. Revenue Code, 2006 have already been instituted for removal of encroachment from the land bearing Gata No.261 measuring 0.1170 hectares. No encroachment has been found on Gata Nos. 262 measuring 0.0970 hectares and Gata No. 272(Ka) measuring 5.2200 hectares 4. In view of the aforesaid instructions, the present petition is disposed of by issuing a direction that proceedings under Section 67 of U.P. Revenue Code, 2006 instituted for removal of encroachment for land bearing Gata No. 261 measuring 0.1170 hectares, situated in Village Shakhuiya Tehsil and District Balrampur, shall be concluded expeditiously in accordance with law.
