No.48 of 2023 in execution of the decree in O.S. No.48 of 2023 in execution of the decree in O.S. No.42 of 2021 in respect of the land to an extent of Ac.3.76 cents situated in Sy.No.552-2 of Bandakammakamma Palle (B.K.Palle) Revenue Village, Madanapalle Mandal, Annamayya District erstwhile Chittoor District (pending on the file of the court of the II Additional District Judge, Madanapalle, Chittoor District presented by the petitioner through the execution court and release the same in favour of the petitioned pending disposal of the above writ petition and to pass Counsel for the Petitioner: 1. GP FOR REVENUE 3 The Court made the following order: Heard Ms. T.Jyothi, learned counsel appearing for Sri Md.Saleem, learned counsel for the petitioner and Sri T.Sanjeeva Rao, learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 6. 2. The grievance of the petitioner in the instant writ petition is against the action of the respondents in keeping the subject land of an extent of Ac.3.76 cents in Sy.No.552-2 of Bandakammakamma Palle (B.K.Palle) Revenue Village, Madanapalle Mandal, Annamayya District erstwhile Chittoor District as Assigned Land under Section 22(A)(1)(a) of the Registration Act, 1908, consequently, sought for a direction to delete the said land from the prohibitory list and to communicate the same to the 6th respondent. 3. It is contended that the subject land initially belonged to an Ex- serviceman, Sri Akula Siddappa, who was granted an assignment of the land in 1959. In terms of G.O.Ms.No.279, Revenue (Assignment-I) Department, dated 04.07.2016, after the lapse of 10 years, Ex-servicemen were allowed to sell the said assigned lands. The petitioner, further placing reliance on the proceedings of the Collector dated 03.05.2023 and the Circular issued by the CCLA dated 04.05.2022, contends that the lands assigned in favour of Ex- servicemen after the lapse of 10 years can no longer be considered assigned lands. As the subject land was assigned 60 years ago, placing it under the prohibitory category is contrary to the GOs and Circular Memos issued in this regard. 4 4. Today, when the matter is taken up for consideration, learned Assistant Government Pleader for Revenue has placed before the Court a copy of the remarks received from the 4th respondent dated 05.12.2025. A perusal of the same would reflect that the land in Sy.No.552/2 over an extent of Ac.3.76 cents was originally assigned to Ex-serviceman Sri Akula Siddappa vide proceedings dated 30.06.1959 under the Ex-serviceman quota. Later, the survey number was subdivided as: 1. Sy.No.552/7 Ac.3.40 cents 2. Sy.No.552/8A Ac.0.15 cents 3. Sy.No.552/8C Ac.0.20 cents 4. Sy.No.552/8B Ac.0.15 cents 5. The District Collector, Annamayya District issued proceedings dated 03.05.2023, deleting the land from the prohibited category under Section 22(A)(1)(a) of the Registration Act, 1908 and it is further stated that there is no objection for the registration of the draft sale deed. 6. The said written instructions of the 4th respondent dated 05.12.2025 are placed on record. 7. Having regard to the contentions advanced, this Court deems it appropriate to dispose of the writ petition by directing the 2nd respondent-The Disrtrict Collector, to communicate the order of deletion of the property from the prohibited category under Section 22(A)(1)(a) of the Registration Act, 1908 to respondent Nos.5 and 6, within a period of four (04) weeks from the date of 5 receipt of a copy of this order. Upon submission of the said proceedings, the 6th respondent is directed to register the draft sale deed forwarded by the II Additional District Judge, Madanapalle, in O.E.P.No.48 of 2023 in execution of the decree in O.S.No.42 of 2021. 8. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
