PUBLIC PROSECUTOR The Court made the following Order: The petitioners are arraigned as Accused Nos. 1 and 2 in C.C. No. 3064 of 2022 on the file of the learned II Additional Chief Metropolitan Magistrate, Vijayawada. The 2nd petitioner is the sister of the 2ndrespondent. 2. The learned counsel for the petitioners submits that, on account of certain family disputes, the 2nd respondent has filed a complaint against her own sister and brother-in-law. It is submitted that the petitioners were married 2 in the year 2010 and that there were some family disputes between the petitioners' family and the 2nd respondent's family. This Court, while admitting the quash petition, has dispensed with the presence of the petitioners. 3. Today, when the matter is taken up for hearing, the learned counsel for the 2nd respondent submits that there are allegations against the petitioners and that the statements of LW 4 and 5 would be crucial, which are to be tried before the trial Court and are required to be tested in trial. 4. The learned counsel for the petitioners requested to dispose off the quash petition by dispensing with the presence of the 2nd petitioner. 5. Considering the same, the presence of the 2nd petitioner shall be dispensed with in C.C. No. 3064 of 2022 on the file of the learned II Additional Chief Metropolitan Magistrate, Vijayawada, subject to the petitioners submitting an undertaking before the learned Magistrate to appear as and when required for the purpose of trial. 6. With these observations, this Criminal Petition is disposed off. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ___________________ JUSTICE HARINATH.N 20.03.2025 PNS 3
