HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CONTEMPT APPLICATION (CIVIL) No. - 4065 of 2025 Court No. - 8 HON'BLE MANISH KUMAR, J. Shri Anubhav Mehrotra, who is appearing in person, has filed impleadment application, which is taken on record. Heard. Present contempt application has been preferred for alleged non-compliance of the judgment and order of the Writ Court dated 12.12.2024 passed in Application Under Section 482 No. 10827 of 2024. The relevant excerpts of the said judgment and order is being reproduced hereinbelow- "9. Charge sheet dated 11.01.2016 in Case Crime No. 28 of 2015, under Sections 452, 325, 323, 504, 506 I.P.C., P.S. Chowk, District Lucknow is hereby quashed. 10. Office is directed to send a copy of this order to the court concerned, forthwith." The applicant has submitted that despite the fact that the Hon'ble High Court has quashed the charge-sheet dated 11.01.2016 filed in Case Crime No. 28 of 2015, the Station House Officer, Chowk, District Lucknow is not treating it as quashed charge- sheet against the applicant and submitting a report regarding pending criminal cases against the applicant while mentioning the Case Crime No. 28 of 2015 and this fact may be verified from the annexure nos. SA Nos. 2 and 3 annexing with the affidavit filed alongwith the impleadment application. On the other hand, learned State Counsel on the basis of instructions received from Shri Bhupendra Singh, Sub-Inspector (Investigating Officer), Police Station Chowk, District Lucknow has submitted that the Police/Investigating Officer is not making any investigation in Case Crime No. 28 of 2015 as the charge-sheet has already been quashed by Hon'ble High Court and the applicant would not be asked to participate in any investigation pertaining to the Case Crime No. 28 of 2015. On perusal of the annexure no. S.A. Nos. 2, it is found that there is no reference of Versus Counsel for Applicant(s) : In Person Counsel for Opposite Party(s) : Anubhav Mehrotra And Another .....Applicant(s) Shri Sanjay Prasad Prin. Secy. Home, U.P. Lko. And Another .....Opposite Party(s) Case Crime No. 28 of 2015 rather there is reference of some other Case Crime No. 27 of 2015. From perusal of S.A. 3, it is found that while submitting the report in the office of District Magistrate, the reference of Case Crime No. 28 of 2015 has been made with a clear report that Hon'ble High Court had quashed the charge-sheet in pursuance of the compromise entered into between the parties, so, it cannot be said that any of the authorities are still treating the Case Crime No. 28 of 2015 as pending. The learned State Counsel on the basis of instructions received from concerned Investigating Officer has already submitted before this Court that the Police department cannot proceed against the applicant in connection with the Case Crime No. 28 of 2015 as the charge-sheet in that case has been quashed by Hon'ble High Court. In view of the facts, circumstances and discussion made hereinabove, the present contempt application is devoid of merit, hence, dismissed.
