This criminal miscellaneous petition has been filed under section 528 of BNSS, 2023 by the petitioner with a prayer for modification of the order dated 17.10.2023 passed in ABA No. 8580 of 2023. It is submitted by the learned counsel for the petitioner that vide order dated 17.10.2023 passed in ABA No. 8580 of 2023, the petitioner was given the privilege of anticipatory bail with the condition to deposit Rs. 86,488/- with the Electrical Executive Engineer, JBVNL, Bokaro along with other conditions. It is further submitted by learned counsel for the petitioner that the petitioner prepared a demand draft in favour of JBVNL, Bokaro but the same was not accepted because the case was registered as Sadar (Mesra) P.S. case no. 491 of 2022. It is next submitted that the appropriate Electrical Executive Engineer is Ranchi East (Ormanjhi) and because of the said discrepancy, the petitioner could not surrender within the stipulated time, hence, it is submitted that the order dated 17.10.2023 passed in ABA No. 8580 of 2023 be modified by substituting the words “Electrical Executive Engineer, JBVNL, Bokaro” with the words “Electrical Executive Engineer, JBVNL, Ranchi East (Ormanjhi)” and the time to surrender before the court below in terms of the order dated 17.10.2023 passed in ABA No. 8580 of 2023 be extended for six weeks from the date of this order. Considering the facts of the case and the submission of the learned counsel for the petitioner, the order dated 17.10.2023 passed in ABA No. 8580 of 2023 is modified by substituting the words “Electrical Executive Engineer, JBVNL, Bokaro” with the words “Electrical Executive Engineer, JBVNL, Ranchi East (Ormanjhi)” and the time for the petitioner to surrender in the court below in terms of the order dated 17.10.2023 passed in ABA No. 8580 of 2023 is extended for six weeks from the date of this order. Hence, the petitioner is directed to surrender before the court below “within six weeks from the date of this order in terms of the order dated 17.10.2023 passed in ABA No. 8580 of 2023”. The order dated 17.10.2023 passed in ABA No. 8580 of 2023 is modified to the aforesaid extent only. This criminal miscellaneous petition is disposed of accordingly. (ANIL KUMAR CHOUDHARY, J.) Smita/-
