Heard learned counsel appearing for the petitioners and learned Standing Counsel appearing for the State-respondents. 2. The captioned writ petition has been filed challenging therein the order dated 15th October, 2025 passed by the Special Land Acquisition Officer, Raebareli and the recovery citation issued by the Tehsildar for recovery of Rs.25,98,721/-. 3. It has been submitted that no doubt the case in respect of title of the petitioners over the land in question is pending before the Board of Revenue, but as on date, there is no order passed by the Board or Revenue in favour of any of the private respondents. Therefore, as on date, there is a clear title in favour of the petitioners. 4. Learned counsel appearing for the petitioners has given an undertaking before this Court that if ultimately somehow the petitioners lose their title over the land in question, they will pay Rs.25,98,721/- to the Government. 5. Keeping in view the undertaking given by learned counsel appearing for the petitioners, we hereby dispose of this present writ petition and provide that till the title dispute is settled by the competent court, the recovery sought through the recovery citation annexed as Annexure No.2 to this writ petition shall remain in abeyance.
