HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12117 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. It is alleged in the prosecution case that, on the assurance given by the applicant along with the co-accused persons, the informant invested a sum of Rs. 50,000/- in the company on the promise that he would receive double the deposited amount within 36 months. However, when the informant later approached the company’s office, he came to know that co-accused Ratan Chandra Dwivedi and other directors of the company had been sent to jail. Learned counsel for the applicant submits that the Managing Director, Ratan Chandra Dwivedi, as well as another Director, Zainuddin Ansari, have already been granted bail by the learned Special Court, and their bail orders have been placed on record as Annexures 3 and 4 to the bail application. The applicant, therefore, seeks parity with the said co-accused. It is further pointed out that co-accused Dharmendra Prajapati has also been granted bail by this Court vide order dated 27.08.2024 passed in Criminal Misc. Bail Application No. 9098 of 2024. The charge sheet in the present matter has been submitted. The applicant has duly explained his criminal antecedents consisting of 32 cases of similar nature pertaining to the same company in paragraph 20 of the bail application. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned AGA has opposed the bail application. Upon consideration of the bail orders passed in favour of co-accused persons, the fact that the offences are triable by the Magistrate, the filing of the charge sheet, the applicant’s disclosure of criminal antecedents of similar allegations, and the circumstance that the applicant is in jail since 14.04.2023, this Court is of the opinion that the applicant deserves to be released on bail. Accordingly, the bail application is allowed.
Let the applicant Ashutosh Tripathi, involved in case crime No. 28/2022, under Sections 409/420 IPC, P.S. Gomti Nagar, District Lucknow, be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court.
