The applicant Nos.1 & 2, who are in custody since 12.04.2025 & 01.04.2025 respectively, have approached this Court for grant of regular bail in connection with Gamharia P.S. Case No.35 of 2025, pending in the court of learned Chief Judicial Magistrate at Seraikella. 3. It appears that the applicants have been made an accused for committing the offence under Section 103(1)/ 238(a) of BNS. 4. It has been submitted by the learned counsel for the applicants that complete set of F.I.R along with its enclosures have been annexed with the present bail application and there is no suppression on his/ her part. Innocence of the applicants has been claimed and undertaking has been given for participation in the trial. It has been submitted that these applicants are daily wagers having no criminal antecedents. On the above basis, prayer for bail has been made. 5. Learned A.P.P has opposed the prayer for bail stating that the weapon and the motorcycle, which have been used in the commission of crime, have been recovered on the confessional statement of the co-accused. 6. Considering the nature of crime and the materials available on record, I am not inclined to enlarge the applicants on bail. Accordingly, the prayer for bail of the applicants is, hereby, rejected.
