HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 1408 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J. 1. Heard learned counsel for the applicant, learned AGA and perused the record. No one appears for the informant despite notice. 2. The accused-applicant seeks bail in FIR/Case Crime No.93 of 2024 under sections 376(2)(n), 504, 506 IPC and section 5-J(ii) and 6 POCSO Act, P.S. Sujauli, District Bahraich. 3. In terms of the FIR, it was alleged that the daughter of the informant aged about 16 years was enticed by the applicant and on the false pretext of marriage, physical relations were formed and she had become pregnant. 4. In the light of the said allegations, the counsel for the applicant argues that the victim has refused to give DNA sample of the child, as is evident from the case diary, annexed with the paper book. It is further argued that the tentative age of the victim is around 17 years. 5. Considering the fact that the relationship continued over a substantially long period of time and the tentative age of the victim being around 17 years and there being no document with regard to exact age of the victim on record to categorically form an opinion with regard to the exact date of birth coupled with the fact that the victim has refused to give DNA sample of the child, the applicant who is in custody since 15.06.2024 and has no criminal history is entitled for the bail.
