I.A. 8807/2025 - SEEKING MODIFICATION OF ORDER DT. 10.03.2025 1. This is an application filed on behalf of the petitioner seeking modification of the order dated 10.03.2025 passed in ARB.P. 703/2024, whereby Mr. Justice Talwant Singh (Retd.) was appointed as the Sole Arbitrator for adjudication of disputes between the petitioner herein and the respondent. 2. It is stated that vide order dated 07.02.2025 passed by a coordinate bench in ARB.P. 702/2024 titled “M/s Sopan Restaurants vs. IRCTC”, Mr. Abhimanyu Singh (Adv) was appointed as the sole arbitrator for adjudication of disputes between the sister company of the petitioner, namely, M/s Sopan Restaurant and the respondent herein. For the said reasons, issue notice. 4. Mr. Shridhar, learned counsel for the respondent accepts notice and on instructions, states that he has no objection if the order dated 10.03.2025 passed in ARB.P. 703/2024 is modified and Mr. Abhimanyu Singh, (Adv) is appointed as the arbitrator instead of Mr. Justice Talwant Singh (Retd.). 5. Since, the dispute in ARB.P. 702/2024 and ARB.P. 703/2024 are of similar nature and the respondents are same, it would be in the interest of justice and in order to avoid conflicting decisions that Mr. Abhimanyu Singh, Advocate is appointed as the sole arbitrator. 6. For the said reasons and with consent of parties, the application is allowed and the order dated 10.03.2025 in ARB.P. 703/2024 is hereby modified and Mr. Abhimanyu Singh, Advocate (Mob. No. 9999918494) is appointed as the arbitrator in place of Mr. Justice Talwant Singh (Retd.) to adjudicate the disputes between the parties herein. 7. All other terms and conditions of the order dated 10.03.2025 shall remain unchanged. 8. The application is disposed of in the aforesaid terms.
