HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW PUBLIC INTEREST LITIGATION (PIL) No. - 3219 of 2019 Court No. - 1 HON'BLE RAJAN ROY, J. HON'BLE RAJEEV BHARTI, J. Heard. This petition was filed in 2019 as Public Interest Litigation inter alia seeking a writ of quo warranto with regard to the alleged illegal appointment of Chairman and Member Secretary of U.P. Pollution Control Board i.e. opposite parties no. 5 and 6. The said persons are no longer functioning as Chairman and Member Secretary. Other persons have been appointed subsequently. As regards framing of Rules sought in relief no. 2, the same have been framed, as informed by Mr. Ashok Kumar Verma, learned counsel for the Board, namely, The Uttar Pradesh Pollution Control Board (Conditions of Service of Chairman and Member Secretary) Rules, 2021. In view of the aforesaid, relief no. 2 has also outlived its utility so has relief no. 3 as subsequently another Chairman and Member Secretary have been appointed. It is informed that another writ petition bearing Writ A No. 9366 of 2023 has been filed challenging the subsequent appointments. In view of this nothing survives for adjudication in this Public Interest Litigation. Disposed of accordingly.
