Order 10/06/2025 This bail application has been filed by the accused-petitioner under Section 483 of B.N.S.S. in respect of FIR No.860/2022 registered with Police Station Kotwali Alwar, District Alwar for the offence under Sections 420, 409 and 120-B of IPC. Learned counsel for the accused-petitioner would submit that the offences alleged against him are triable by Magistrate. Charge- sheet has been filed before the Trial Court; hence, he is no longer required in custodial interrogation nor any recovery is liable to be made from him. The accused-petitioner is behind the bars since 13.09.2024. Trial of the case is likely to take considerably long time. Taking into consideration the overall facts and circumstances of the case, this Court without expressing any opinion on the merits and demerits of the case, deems it just and proper to enlarge the accused-petitioner on bail. Accordingly, the bail application is hereby allowed. The accused-petitioner-Yogesh Kumar @ Gaurav S/o Shri Sohan Lal shall be released on bail in pursuance of FIR No.860/2022 registered with Police Station Kotwali Alwar, District Alwar on furnishing personal bond of Rs.1,00,000/- along with two sureties of the like amount. That apart, the accused-petitioner shall also follow the conditions as under:- (i) He shall not tamper with any evidence, nor would influence the witnesses in the case. (ii) He shall not leave the country without prior permission of the Court. (iii) He shall co-operate in the trial and shall attend each and every date of hearing in the trial, until and unless his presence is exempted by the trial Court. (ANAND SHARMA (V. J.)),J DIKSHA /73
