Heard learned counsel for the petitioner, learned Additional Chief Standing Counsel for the State, Dr. Uday Veer Singh, learned counsel for respondent nos. 3 & 4 and perused the record. Instant petition has been filed with the following prayers:- "(A) issue a writ, order or direction in the nature of Mandamus commanding the Opposite Parties to appoint the petitioner on a suitable post on compassionate grounds under the provisions of The Uttar Pradesh Recruitment of Dependents of Government Servants Dying in Harness Rules, 1974 (UP Dying in Harness Rules) in view of his representations dated 07-05-2024 and 15-05-2024 and 03-06-2025 as contained in Annexure No. 4.5 and 7 to this writ petition respectively. (B) to issue such other Writ, Order or Direction as this Hon'ble Court may deem just and proper in the facts and circumstances of the case. (C) to award the cost of the Writ Petition to the Petitioner." After arguing at length, learned counsel for the petitioner submits that the interest of justice would be sub-served if this Hon'ble Court may be pleased to give liberty to the petitioner to move a fresh representation before the respondent no. 3 and he may be directed to consider & decide the same, within stipulated period of time as may be fixed by this Court. Learned counsel for the opposite parties have no objection to the contention aforesaid. And 3 Others .....Respondent(s) Be that as it may, without entering into the merit of the case, the petitioner is permitted to move a fresh representation within period of 15 days, and if such representation is moved within aforesaid period, the respondent no. 3/District Basic Education Officer/Basic Shiksha Adhikari, Gonda is hereby directed to consider and decide the same, within a period of six weeks, in accordance with law, from the date, a certified copy of this order is produced before him.
