JUSTICE A. GUNESHWAR SHARMA O R D E R 20-08-2025 [1] These matters are taken up as an unlisted item in the supplementary due to urgency involved in the case. [2] Heard Mr. M. Hemchandra, learned senior counsel assisted by Mr. M. Rendy, learned counsel for the petitioners and Mr. H. Debendra, learned Dy. Advocate General assisted by Mr. A. Bheigya Meitei, learned junior Government counsel for the State respondents. [3] By the present writ petition, the petitioners approached again this Court even after disposal of the earlier writ petition being WP(C) No. 627 of 2025 vide order dated 18-08-2025 thereby observing that the State respondents shall first verify the possession of the petitioners and after proper verification, eviction and demolition be done on the encroached area upon the government land. Mr. M. Hemchandra, learned senior counsel for the petitioners, submits that in other matters, the Court gives protection to the petitioners that no eviction and demolition of the possession of the NINGOM BAM VICTORIA Digitally signed by NINGOMBAM VICTORIA Date: 2025.08.20 14:15:59 +05'30' WP(C) No. 640 of 2025 & MC(WP(C)) No. 597 of 2025 petitioners and their structures be done within their patta land and in the order dated 18-08-2025, such important protection is missing and also contrary to the direction given by this Court in the order dated 18-08-2025 from proper verification, the State respondents are going to demolish some portion of the structures of the petitioners on the basis of 1960 map without any proper verification. It is also stated that the petitioner No. 1 has submitted a reminder representation dated 18-08-2025 to the original representation dated 31-03-1990 for amalgamation and allotment and the representations are pending. It is submitted that before giving any final decision, the petitioners’ earlier representations may also be considered. [4] In the circumstances, the writ petition is disposed of at this stage in continuation of the order dated 18-08-2025 in WP(C) No. 627 of 2025 filed by the same petitioners that the possession of the petitioners and their structures within the patta land are protected from eviction and any eviction and demolition should be after due consideration by giving opportunity to the petitioners of being heard. The petitioners are at liberty to file a fresh representation, if any, in continuation of the earlier pending representations. [5] With this observation, the writ petition is disposed of. MC(WP(C)) No. 597 of 2025 is also disposed of. [6] Furnish a copy of this order to the learned counsel appearing for the parties in the course of the day. JUDGE Victoria
