GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.12758 OF 2024 ORDER: The present Writ Petition is filed seeking for the following relief: “to declare the action of the Respondents in withholding the payment of pending amounts of Rs.17,25,882/- in relation to the work executed by the Petitioner as bad, illegal, arbitrary, improper, unjust and against the Article 21 of constitution of India and consequently direct the respondents to pay the amounts of Rs 17,25,882/-”. 2. The case of the Petitioner is that he is a Civil Contractor. The contract work listed below was granted to the Petitioner by the respondents vide Agreement No.39/2023-2024, dated 21.12.2023: “1) Upgradation of CC Roads in 21st and 22nd Wards in Piduguralla Municipality”. 3. The contention of the Petitioner is that after execution of the said work, a final bill was prepared for a sum of Rs.17,25,882/- as per the sanctioned orders and sent the same to Respondents for payment. As the payment of the said amount has not been 3 made by the respondents, the Petitioner has approached this Court by way of the present Writ Petition. 4. On instructions, the learned Standing Counsel appearing for the Respondent No.3, while admitting the execution of work by the Petitioner, submits that the Assistant Engineer, Piduguralla Municipality, recorded the measurements for the work and prepared the bill and the same was sent to the Audit Office, Narasaraopet, for pre-audit purposes and once the bill is passed by the Audit Department, the Bill will be uploaded in the CFMS Portal. 5. Considering the submissions made by both the counsels, the respondents are granted Four (04) months time to process the bill and accordingly make payment to the Petitioner. 6. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
