Kaushik, learned Addl. P.P. for the State respondent. This application has been preferred by the petitioner namely, Shakir Hussain under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, praying for release on bail, who was arrested on 31.07.2025 in connection Page No.# 2/3 with Dabaka P.S. Case No. 135/2025 (G.R. Case No. 808/2025) under Sections 21(b)/27A of the NDPS Act. The allegation as reflected in the FIR is that on 22.07.2025, an information was received from a secret source that dealing of huge quantity of NDPS articles were going to happen on Dabaka Town by one drug paddler namely Mehbub Alom, there after O.C. of Dabaka P.S. made a G.D.E. No. 10 dated 22/07/2025 and deputed a team to take needful action and reaching the place of occurrence, the team found one Medhbub Alom and apprehended him and during the search suspected drugs were recovered from his possession and 1.13 numbers of plastic container filled with suspected heroine, 2.11 numbers of empty plastic container total weight 19 grams were found. Accordingly, FIR was registered as Dabaka P.S. Case No. 135/2025 (G.R. Case No. 808/2025) under Sections 21(b)/27A of the NDPS Act and the petitioner was arrested. Case diary is received and perused. It appears that no recovery was made from the possession of the present petitioner but from the C.D. it appears that petitioner is involved in the said activity of supply of illicit drugs which is discernable in the statement of the petitioner himself. But other than that, there appears no cogent materials against the present petitioner and the recovery was made from other accused person. Be that as it may, as the amount involved is intermediate quantity and the petitioner has spent 45 days in custody, prayer for bail is allowed. Accordingly, it is directed that the petitioner namely Shakir Hussain be released on bail in connection with the aforementioned case, on furnishing a bond of Rs. Rs. 50,000/- (Rupees fifty thousand only) with two sureties each of Page No.# 3/3 like amount to the satisfaction of the learned Special Judge, Srimanta Sankardev Nagaor, Hojai, subject to the following conditions:- (1) That the petitioner shall make himself available for interrogation by the Investigating Officer as and when required; (2) That the petitioner shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any other police officer, and (3) That the petitioner shall not hamper with the investigation or tamper with the evidence of the case and shall not leave the jurisdiction of the learned Special Judge, Srimanta Sankardev Nagaor, Hojai,without prior permission.
