Affidavit filed by the respondent-authority is taken on record. 2. In the present writ petition, following relief has been sought for:- "(i.) a writ, order or direction in the nature of mandamus thereby directing the Opp. Parties to pay the compensation of the acquired land measuring areas 8*100 meter 0.080 hectare from the Gata No. 178 M/0.617, 181M/0.077, 179/0.107 hectares situated at Village Baiti, Pargana- Kumhar, Tehsil-Maharajganj, District - Raebareli to the petitioner as per existing market rate." 3. It appears that by an order dated 15.12.2022, the demarcation proceedings were completed by the Sub-Divisional Magistrate. 4. Learned counsel appearing on behalf of the petitioner submitted that he has filed an appeal against the aforesaid order before the Commissioner which is still pending. 5. In our view, unless this matter is decided by the Commissioner, no compensation will become payable to the petitioner. 6. In light of the same, we are of the view that unless this matter is decided by the Commissioner, the compensation shall not become payable to the petitioner. 7. Accordingly, the Commissioner is directed to expeditiously hear and decide the matter preferably within a period of three months from date Versus Counsel for Petitioner(s) : Rakesh Kumar Counsel for Respondent(s) : C.S.C.
