HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 9546 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant and learned A.G.A. for the State as well as perused the record. The accused-applicant seeks bail in Case Crime No.79 of 2021 under Section 420, 467, 468, 471, 120-B IPC, Police Station Gazipur District Lucknow. The allegation in the prosecution case is that the applicant, in connivance with the co-accused persons, is alleged to have prepared forged documents in order to obtain pecuniary benefits. He is further alleged to be the founder of Surya Nursing and Paramedical Sciences Institution, while his son is stated to be its Director.
Learned counsel for the applicant submits that the applicant was the Senior Manager at Baroda U.P. Gramin Bank, Branch Akbarpur, District Ambedkar Nagar. He superannuated on 30.09.2018 after completing 60 years of age. Presently, he is an ailing person aged about 67 years. He has explained the criminal history of one case in paragraph 16 of the bail application. He is innocent. The offence is triable by a Magistrate. The FIR was registered in the year 2021 and, till the filing of the bail application, the investigation had not been completed. He is in jail since 22.08.2025.
Learned counsel for the applicant further undertakes that the Versus Counsel for Applicant(s) : Rehan Ahmad Siddiqui Counsel for Opposite Party(s) : G.A. Sushil Pandey .....Applicant(s) State Of U.P. Thru. Secy. Home Lko. .....Opposite Party(s)
applicant shall cooperate in the investigation and shall remain present as and when his presence is required. It is further submitted that there is no possibility of the applicant of fleeing away after being released on bail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned A.G.A. has opposed the bail prayer of the applicant but could not dispute the facts mentioned above. I have considered the arguments advanced by learned counsel for the parties as well as perused the record. On due consideration of the facts that the applicant is in jail since 22.08.2025; the offence is triable by a Magistrate; the investigation is pending for more than three years; and in view of the undertaking given by learned counsel for the applicant that the applicant shall cooperate with the investigation and will remain present as and when his presence is required; also considering the fact that the applicant is an ailing person aged about 67 years and without expressing any opinion on the merits of the case, I find it to be a fit case for enlarging the applicant on bail. Accordingly, the bail application is allowed. Let the applicant Sushil Pandey, involved in the aforesaid FIR/Case crime number, be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court.
BAIL No. 9546 of 2025 2
Any other condition(s) which the trial court/concerned court may deem fit and proper, in the circumstances of the case, may also be imposed. It is clarified that the observations made in this order are confined to the present bail application and shall have no bearing on the merits of the trial.
