"a) Issue a writ, order or direction in the nature of mandamus directing respondent no.2 to 6 to register a First Information Report (FIR) against Kamal Khan S/O Ramjan Khan and other family members, residents of Village Andahanpurva (Parsohana), Karmohna, Post-Matehi Kala, Police Station Motipur, District Bahraich, in respect of the incident which occured on 23.09.2025 at Village Andahanpurva (Parsohana), as detailed in the instant petition. b) Issue a writ, order or direction in the nature of mandamus directing respondent nos.2 to 6 to exhume the body of "Farheen Shania" @ Moti, aged about 18 years, D/o Kamal Khan buried in the graveyard of Village Andahanpurva (Parsohana), Karmohna, Post Matehi Kala, Police Station Motipur, District-Bahraich, and to conduct a lawful postmortem examination in accordance with law. c) Issue a writ, order or direction to the respondents for constitution of a Special Investigation Team (SIT) of officers of unimpeachable integrity, to conduct a fair, impartial and time-bound investigation into the alleged incident of honour killing of
"Farheen Shania" @ Moti and the subsequent illegal burial without police intimation Versus Counsel for Petitioner(s) : Sri Shailendra Srivastava, Vijyant Nigam Counsel for Respondent(s) : C.S.C. Akhand Aryavart Arya Tridandi Mahasabha Thru. National President Rishi Kumar Trivedi .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And 5 Others .....Respondent(s)
or postmortem, with further directions to submit periodical status reports before this Hon'ble Court."
3. On being asked as to what is the source of information of the petitioner that honour killing had taken place, learned counsel only referred some newspapers reports. Most important, we find that in the entire writ petition there is no averment that the petitioner ever went to the concerned police station or to the Superintendent of Police concerned apprising them about the aforesaid incident if there is any truth in it and requesting for lodging of an FIR. If the officials were not responding then there are procedures prescribed under the criminal law, which could have been availed by the petitioner if it has locus-standi. There is nothing on record to show that the petitioner availed the said remedies. 4.
In view of the above, we see no reason to entertain this PIL at the behest of the petitioner. 5. Accordingly, this petition is disposed of. December 12, 2025 S.P.
