Heard Mr. Alok Kirti Mishra, learned counsel for the petitioner, Mr. Rajiv Singh Chauhan, learned Additional Chief Standing Counsel for the State and perused the records. Notice to respondent no. 5 is hereby dispensed with. The instant writ petition has been filed with the following prayers:- "i) Issue a writ, order or direction in the nature of mandamus commanding the opposite parties to make payment of salary to the petitioner in the pay scale admissible to the post of Head Master of Primary School w.e.f. 01.07.2013 along with arrears of salary in order to secure the ends of justice. ii) Issue a writ, order or direction in the nature of mandamus commanding the opposite party no 3 extend the benefit of the judgement and order dated 10.9.2024 passed in writ petition no. 7670/2024 chhotey lal ram versus state of UP and others which is content as annexure no.8 to this writ petition. iii) Issue such other order or direction which this Hon'ble Court may deem just fit and proper under the circumstances of the case. iv) Award the costs of the writ petition in favour of the petitioner." The contention of counsel for the petitioner is that the payment of salary to the petitioner in the pay-scale admissible to the post of Headmaster of Primary School with effect from 01.07.2013 along with arrears of salary, has not yet been paid as yet. He submitted that he has made a representation to the authority concerned, but the authorities are not paying any heed and Versus Counsel for Petitioner(s) : Alok Kirti Mishra Counsel for Respondent(s) : C.S.C. Satya Prakash Bajpai .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. Social Welfare Deptt. U.P. Lko. And 4 Others .....Respondent(s) sitting tight over it. He further argued that this issues has already been dealt in Writ A No. 7670 of 2024(Chhotey Lal Ram Versus State of U.P. and 4 Others) vide final judgment and order dated 10.09.2024 and submits that the present petitioner is squarely covered with the aforesaid judgment. Learned counsel for the State could not dispute the aforesaid submissions. Upon considering the submissions of counsel for the parties, the counsel for the petitioner is given liberty to move a fresh representation within period of 15 days before respondent no. 3 and if such representation is moved within aforesaid period, the respondent no. 3/Director, Social Welfare, U.P. Lucknow is hereby directed to consider and decide the same in light of the judgment and order passed in Chhotey Lal Ram(Supra), within period of two months, from the date, a certified copy of this order is produced before him.
