03. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical) Mode.
2. Heard learned counsel for the parties.
3. The present Writ Petition has been filed inter alia with the following prayer:-
“Under the aforesaid
facts and circumstances, it is therefore, prayed that this Hon’ble Court may graciously be pleased to: (i) admit / allow this Writ Petition; (ii) direct / order to include the Petitioner’s service under Odisha Pension Rules, 1992; (iii) direct / order to open GPF Account of the Petitioner under GPF Rules, 1938; (iv) direct / order to promote the Petitioner to the post of Asst. Programmer of Odisha Legislative Assembly, w.e.f. 21.10.2010, the date on which the admitted junior of the Petitioner got promoted
to the post of Asst. Programmer with all service and consequential benefits; (v) pass such other order(s) or issue direction(s) as may be deemed fit and proper in the bona fide interest of justice.”
4. In course of hearing, learned Senior Counsel appearing for the petitioner contended that he may be permitted to move O.P. No.1 for consideration of his grievance as made in the Writ Petition.
5. Mr. P.K. Nanda, learned counsel appearing for Odisha Legislative Assembly has no serious objection to the course of action proposed by the learned Senior Counsel appearing for the petitioner.
6. Having heard learned counsel for the parties and considering the submissions made, this Court while disposing the Writ Petition, permits the petitioner to move an application before O.P. No.1 for consideration of his grievance. It is observed that if any such application will be moved before O.P. No.1 within a period of 3 (three) weeks hence, O.P. No.1 shall take a lawful decision on the same within a further period of 3 (three) months from the date of receipt of such application.
7. The Writ Petition stands disposed of.
