HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 10575 of 2025 Court No. - 6 HON'BLE JASPREET SINGH, J. Heard learned counsel for the petitioner. Notice on behalf of respondent nos. 1 has been accepted by the office of the learned Chief Standing Counsel. Sri Anurag Kumar Singh, learned counsel has accepted notice on behalf of respondent nos. 2 and 3. The instant case reflects a sorry state of affairs, inasmuch as, the petitioners have moved an application for getting their names enrolled in the electoral rolls and for the aforesaid purpose had moved an application, a copy of which has been brought on record as Annexure No. 7. Since the said application has not been decided, the petitioners have approached this Court seeking a limited relief and appropriate directions be issued so that the application of the petitioners for getting their names incorporated in the electoral rolls may be decided. Sri Devendra Mohan Shukla, learned Additional Chief Standing Counsel has raised an issue that the application of the petitioner is not in consonance with the the rules prescribed, however, a specific query was put to him that in case if the said application was received and it was not in the prescribed format, what prevented the State Authorities of informing this basic information to the petitioner so that the needful may be done rather than compelling the petitioners to approach this Court. It is apparently this stand of the State which directly or indirectly engages the Versus Counsel for Petitioner(s) : Sanjay Kumar Singh, Prabhu Sharan, Shashi Kant Shukla Counsel for Respondent(s) : C.S.C., Anurag Kumar Singh Piyush Mishra And Another .....Petitioner(s) State Of U.P. Thru. Addl. Chief Secy. Panchayati Raj Lko. And 4 Others .....Respondent(s) precious time of the Court in fruitless litigation. If the State Authorities are alive to the situation, then such frivilous or meaningless litigation would not have to be engaged by the Court. Be that as it may, the instant petition is disposed of with a direction to the petitioner to move a fresh application in accordance with rules for getting their names incorporated in the Nagar Panchayat and in case if such an application is moved within a period of two weeks from today, the Authorities concerned shall consider and decide the same expeditiously strictly in accordance with law.
