HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 10615 of 2025 Court No. - 3 HON'BLE SHEKHAR B. SARAF, J. HON'BLE MANJIVE SHUKLA, J. 1. Heard Shri Ashutosh Singh and Shri Prashant Singh, Advocates holding brief of Shri Sanjeev Kumar Singh, learned counsel for the petitioner, learned counsel appearing for Union of India and learned Additional Chief Sanding Counsel for the respondent no.3. 2. The instant writ petition has been filed by the petitioner with the following main prayer: "1. Issue a writ of mandamus directing Respondent No.2 (Regional Passport Officer, Lucknow) to renew and issue the passport of the petitioner in connection with File No. LK3075456612425 before Regional Passport Office,Lucknow. " 3. It is evident from the facts that there is no criminal case whatsoever pending against the petitioner. It appears that the police authorities have given a report, wherein they have indicated that there is an apprehension that the petitioner may misutilize the passport due to the fact that some of her family members have been convicted under Sections 396, 411 and 34 of I.P.C. 4. The above apprehension of the police, in our view, cannot be a justification for non-renewal of the passport of the petitioner which is a fundamental right of the petitioner. The authorities are not able to indicate any substance, wherein the petitioner has been found to be involved in the Versus Counsel for Petitioner(s) : Sanjeev Kumar Singh Counsel for Respondent(s) : A.S.G.I., C.S.C. Smt. Anjum Aara .....Petitioner(s) U.O.I. Thru. Secy. Ministry Of External Affairs New Delhi And 2 Others .....Respondent(s) criminal activities of her family members. 5. In light of the same, we do not see any reason as to why the passport should not be renewed. The authorities are directed to proceed in accordance with law and renew and issue the passport of the petitioner within a period of four weeks from today. 6. Accordingly, the writ petition is disposed of. November 17, 2025 akhilesh/- WRIC No. 10615 of 2025 2 (Manjive Shukla,J.) (Shekhar B. Saraf,J.)
