HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CONTEMPT APPLICATION (CIVIL) No. - 3470 of 2025 Court No. - 8 HON'BLE MANISH KUMAR, J. The present contempt application has been preferred for alleged non compliance of interim order dated 03.12.2024 passed in Application U/S 482 No. 9573 of 2024. The relevant extracts of the same are quoted hereinbelow:- "8. Till the next date of listing, status quo as it exists today, shall be maintained. 9. The S.D.M. of the area concerned shall ensure that no construction of road be made on the property in question. 10. On the next date area lekhpal shall also appear before this Court along with the site plan of the property in question." Learned counsel for the applicant has submitted that one Sri Ram Tirath @ Tirath Raj has started encroaching the pathway and despite the representation made to the respondent on 14.05.2025, no action has been taken by the respondent. It is nothing but a wilful and intentional disobedience of the interim order dated 03.12.2024. On being asked from learned counsel for the applicant as to when Sri Ram Tirath @ Tirath Raj has started encroaching the pathway for which there is an order of status quo, he is unable to show the same, so it cannot be ascertained when Sri Ram Tirath @ Tirath Raj had started encroaching the land, whether prior to 03.12.2024 or after that date. He has also not enclosed any photograph showing that pathway is encroached by Sri Ram Tirath @ Tirath Raj as alleged in the contempt application, hence, no case of contempt is made out.
