2.
Learned counsel for the petitioners submits that the accused- petitioners are innocent and they have been falsely implicated in these cases. He further submits that the accused-petitioners have been in judicial custody since long and the conclusion of the trial will take long time, hence the petitioners may be enlarged on bail.
3. Learned Public Prosecutor has opposed the submissions made by the learned counsel for the petitioners and submits that six and twelve cases were pending against the accused- petitioners-Sunil Kumar & Vikas respectively.
4. Heard learned counsel for both the parties and perused the material available on record.
5. Taking into consideration the overall facts and circumstances of these cases, but without expressing any opinion on the merits and demerits of these cases, this Court deems it just and proper to enlarge the petitioners on bail, subject to conditions.
6. Accordingly, the bail applications under Section 483 B.N.S.S., 2023 are allowed and it is ordered that the accused-petitioners namely 1.Sunil Kumar @ Kalu S/o Shri Babulal 2. Vikas @ Vikki S/o Kishanlal shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned Trial Court for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so. Furthermore, taking note of the criminal antecedents registered against the accused-petitioners, as an extended interpretation of the provisions of ‘community service’ as
[2025:RJ-JP:25528] (3 of 3) [CRLMB-6196/2025] enshrined under the Bhartiya Nayay Sanhita, and as a reformative approach to re-include the accused-petitioners back in the society with a better vision, aim and zeal in life, this Court deems it fit to impose an ancillary condition upon the petitioners, therefore, it is
directed that the accused-petitoners shall contribute to the Swach Bharat Abhiyan – initiative of the government, for a period of two months from the date of enlarging on bail, on two hours per day basis, as an honorary work, under the supervision and directions of the SHO qua the FIR (supra) in consonance with the directions of the Municipal Corporation/ Local Administrative authorities concerned.
