Matter relates to transfer of the petitioner on the ground of distance in between the present school of the petitioner and his place of residence. Last application was made by the petitioner on ‘Utsashree Portal’ on 20th September, 2022 and same was forwarded by the school authority where petitioner is working to the District Inspector of School (S.E.) concerned on 30th September, 2022 for taking necessary steps. However, on perusal of a document at page 16 of the writ petition it appears that further 2 steps could not be taken to decide transfer application of the petitioner since poor pupil- teacher ratio in the school where petitioner is working and dearth of assistant teachers. It is submitted by the learned advocates representing the respondents that poor pupil- teacher ratio does not permit transfer of the petitioner and transfer application of the petitioner, which is made on the ground of distance, ought not to be considered. In addition thererto, it is also pointed out on behalf of the respondents that present teaching strength of the school may not permit transfer of the petitioner. In view of aforesaid submissions and taking note of the documents at page 16 of the writ petition, writ petition is disposed of with a leave to the petitioner to apply afresh for transfer in future if pupil-teacher ratio of the school is improved and teaching strength is augmented.
