By this application filed under Section 389 of the CrPC, the petitioner Sri Sanjay Das has prayed for suspension of sentence imposed upon him by the learned Additional Sessions Judge – cum- Special Judge (POCSO), Barpeta in Special POCSO Case No. 87/2022. I have gone through the impugned judgment. After hearing the learned counsel for both sides, it is hereby directed the Judgement and order dated 30.06.2023 passed by the learned Additional Sessions Judge –cum- Special Judge (POCSO), Barpeta in Special POCSO Case No. 87/2022 whereby the present applicant Sri Sanjay Das was convicted and sentenced shall remain stayed till disposal of the connected appeal. The applicant Sri Sanjay Das shall be allowed to go on bail of Rs.25,000/- with one surety of like amount to the satisfaction of the learned Additional Sessions Judge –cum- Special Judge (POCSO), Barpeta.
