The names of Sri Rahul Verma and Sri Ravi Krishna, Advocates are shown in the cause list as the counsel for the applicants. 3. This application has been filed with the following prayer:-
"To quash the order taking cognizance dated 15.02.2025 and consequential entire proceeding including charge sheet dated 19.11.2024 arising out in case no. 5300 of 2025 (state vs. Krishna Kumar Verma) arising out of Case Crime No. 0877 of 2024 under sections 498-A, 323, 504, 506 of IPC, section 3/4 of Dowry Prohibition Act, Police Station- Kotwali, District- Barabanki, pending in the Court of Chief Judicial Magistrate, Barabanki."

3. It is submitted that marriage of applicant no. 1 was solemnized with respondent no. 2 and they were enjoying their matrimonial life, but due to some trivial issues, respondent no. 2 lodged the F.I.R. on the basis of concocted facts dragging all the in- laws, including the husband. However, the Investigating Officer submitted the charge sheet in mechanical manner, on which, the court below has passed the impugned summoning order. Learned counsel for the applicants also submits that there is every possibility that the matter can be resolved, in case, the matter is sent to the Mediation & Conciliation Center of this Court. 4. Learned A.G.A. has no objection, in case, the matter is sent for Mediation & Conciliation Center of this Court. 5.
Considering the arguments advanced by the learned counsel for the applicants as well as learned A.G.A. and going through the contents of F.I.R., charge sheet, summoning order and other documents, it is evident that the genesis of the case in question is matrimonial dispute and the possibility of settlement cannot be ruled out. It is, therefore, appropriate to send the matter to the Mediation & Conciliation Center of this Court. 6. Issue notice to respondent no. 2. 7. List this case on 15.12.2025, on which date, applicant no. 1 and respondent no. 2 shall remain present before this Court. 8. S.H.O., P.S. Kotwali, District Barabanki is directed to ensure the presence of respondent no. 2 before this Court on the next date. 9. Applicants are directed to deposit a sum of Rs.40,000/- before the Senior Registrar of this Court within 10 days from today. 10. Till the next date of listing, impugned proceedings shall remain stayed. 11. In case, the applicants fail to deposit the amount, as aforesaid, this interim order shall automatically stand vacated."
5. The office report reveals that steps are not taken within the stipulated time and the amount has also not been deposited as directed by means of aforesaid order. 6. The private respondent is present today alongwith Lady Sub Inspector- Ms. Rubi Devi, Police Station- Kotwali, Barabanki. 7. It is evident from the record that on the last date, on the submissions of the applicants' counsel that as there is possibility of settlement, the mater may be sent to Mediation and Conciliation Centre, the order was passed NA528 No. 1740 of 2025 2
for depositing amount of Rs. 40,000/- before Senior Registrar of this Court within ten days from the date of the order, but the same has not been deposited till date. Therefore, this Court is of the view that the applicants have deliberately violated the directions of this Court issued on
26.11.2025. 8.
With the above observations, the present application is dismissed. December 15, 2025 Arpan NA528 No. 1740 of 2025 3 (Rajeev Singh,J.) Digitally signed by :- ARPAN High Court of Judicature at Allahabad, Lucknow Bench
